Q. Am I disabled?
A. The Social Security defines disability as the “inability to engage in substantial gainful activity by reason of any medical impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.”

Q. What if I am denied benefits?

A. There are two disability programs:
1. Supplemental Security Income is a federal welfare program for those who are either disabled or over sixty-five. Certain income and asset limitations apply to SSI.
2. Social Security Disability is a program for people that have worked and paid into the disability program. Generally applicants must have worked for five of the last ten years. Social Security calculates the period worked by the number of quarters worked rather than the number of years. We will determine your qualifications for each program.

Q. Doesn't it take a long time to be approved?
A. Yes, The time delays are the most frustrating factor for both claimants and attorneys. It is not uncommon for a case to take nine months if the case goes to hearing.

Q. Can I continue to work full time and qualify for disability?
A. No, You can work part time but you can't earn more than Substantial Gainful Activity (small amount of income) per month to qualify for benefits. Currently the SGA is $1000 gross per month wages, but generally we suggest that your part time work not exceed $800 gross per month wages.
